1. Claimant had been employed for 24 years
2. There was a serious verbal altercation between him and another employee-looks very much like both employees were very much out of line
3. Claimant raised a Grievance, claiming the various threats made to him were contrary to a safe system of work
4. Employer decided not to bother investigating the Grievance, and Summarily dismissed him-apparently for the "harrassment" of making a Grievance
5. Claimant brings claims for Unfair Dismissal, Wrongful Dismissal, and adds in some Discrimination stuff
6. Tribunal finds in his favour on UD/WD, and gives him 1/2 on the Discrim. Also says he was partly to blame for all this, so any award will be reduced by an unknown %age
It is always Grievance before Disciplinary. Unless you want to lose on UD. The WD is also a gimme-it is for the lack of notice pay, which would ordinarily be at least 3 months' pay with this length of service.
2 people appear to have acted poorly. 1 not disciplined, 1 summarily dismissed.
FWIW, in the limited facts available to me, the Discrim looks surprising-it does look like Age Discrim and not Sex Discrim. But I wasn't there, and have not heard the evidence.
Forget the Headline. Imagine being employed somewhere for 24 years. And being summarily fired for making a complaint.
PS-there is a good rule for how serious to treat claims of Discrim. If employed for less than 2 years, can't claim UD, and WD normally not worth the bother. So Discrim claims there are more likely to be baseless. Whereas here, the Discrim may well be far less than the UD/WD claim.
