Legal privilege is a difficult concept. I struggle to understand it in English Law, and certainly don't pretend to know US Law.
Under English Law, these communications were legally privileged (which means other side not entitled to see them/use them). Trouble is, can lose that privilege sometimes when inadvertently give it to the other side. So (for example) if 1 privileged document is within a larger bundle, can usually retain privilege. Whereas you give all the stuff over like this, you lose the legal privilege, and it is all admissible.
He is likely to be suing his Lawyers big time. They have been incredibly stupid.

He'd accidentally sent two years' worth of potentially damaging text messages from Jones's phone to the lawyer acting for the parents - messages, he was told, that completely disproved the shock jock's claims in court that he'd never mentioned the shootings in any private communications and strongly suggested he'd perjured himself.
The parents are so dignified in this despite all that has gone on. I said earlier in the thread that he faces another three cases. Unfortunately it appears that there are only another two. Although the good thing is that he has already lost all the cases. He has to appear just to determine how much he has to pay. Hopefully he will end up absolutely skint.
