I have advised thousands of motorists about motoring prosecutions. And not a single one has related to this.
I have dealt with 1 or 2 where the Police have said that this could be an offence. But absolutely none where a charge was brought. And not every failure to follow the Highway Code is a Criminal Offence.
In any event, I believe it is the case that motorists are not flashing their headlights to warn them of a mobile speed camera. They are merely alerting motorists to the fact that people may be braking sharply ahead, and that there is an increased risk of an accident ahead...although can promise to stop doing it if a policeman is having a bad day
