Migrant who pleaded for time to ‘make up reason’ spared deportation
‘Typo-riddled’ document allows migrant to avoid removal
A Kenyan asylum seeker has been allowed to remain in the UK after a judge found a ruling dismissing her claim was “riddled” with errors and typographical mistakes.
The married asylum seeker, who was granted anonymity, fled Kenya in 2018 after her family discovered she was having an affair with a woman. She feared that she would be killed by her husband or the authorities if she was deported and returned to the country.
Her case was initially dismissed by a lower-tier immigration tribunal, which ruled she would not be at risk of being killed or tortured if she went back to Kenya.
However, following an appeal, an upper immigration tribunal found that the judgment dismissing her claims contained several “careless” errors and “misstatements” of evidence.
