1. These employees were nearly all travelling between either England or Scotland, to Northern Ireland/Ireland/France/Holland. Not so easy trying to prevent the Employer shifting contracts to 1 of those countries. So you need those countries to co-operate-otherwise Employer bounces contracts from (say) France to Cyprus. That takes time
2. There is an element of shutting the door after the horse has bolted. Lots of these 800 would now like the cheque, please. The big one DP are offering. Not the (I fear) smaller 1 the Tribunals would give
